1. Acceptance of Terms

By accessing and using SocialHOA ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this Service.

2. Description of Service

SocialHOA provides a web-based platform for Homeowners Associations (HOAs) to manage their communities, including but not limited to:

  • Community marketplace for buying, selling, and trading
  • Announcement and communication tools
  • Report and maintenance request management
  • Member directory and profiles
  • Billing and payment tracking for dues and utilities
  • QR code generation for access control

3. User Accounts and Registration

To use the Service, you must register for an account using Google authentication. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Subscription Plans and Billing

SocialHOA offers both free and paid subscription plans:

  • Free Plan: Up to 3 members with basic features
  • Paid Plans: Plans A through H with increased member limits and features
  • Subscriptions are billed monthly in advance
  • You may upgrade, downgrade, or cancel your subscription at any time
  • Price changes will be communicated 30 days in advance
  • No refunds for partial months unless specified in our Refund Policy

5. User Content and Conduct

Users may post content including marketplace listings, announcements, reports, and comments. You agree to:

  • Not post illegal, harmful, threatening, abusive, or defamatory content
  • Not impersonate others or misrepresent your affiliation
  • Not post spam or unsolicited commercial content
  • Respect intellectual property rights
  • Comply with all applicable laws and regulations

We reserve the right to remove any content that violates these terms or is otherwise objectionable.

6. Payment Processing

All subscription payments are processed through RevenueCat and Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. You are responsible for:

  • Maintaining valid payment information
  • Ensuring sufficient funds for recurring charges
  • Updating payment details if they change
  • Notifying us of any billing disputes within 30 days

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and use your data as described in that policy. Key points:

  • We store your data securely using Firebase
  • Your data is isolated to your HOA community
  • We do not sell your personal information
  • You retain ownership of your content
  • You can request data deletion at any time

8. Service Availability

We strive to provide 99.9% uptime, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Technical issues beyond our control
  • Force majeure events

We will provide advance notice of scheduled maintenance when possible.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by RFX Studios and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, RFX Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes via email or through the Service. Your continued use after changes constitutes acceptance of the modified terms.
